On August 26, 1969, a criminal complaint was filed charging the defendant with the offense of battery, a warrant issued and the defendant was arrested. On August 27 the defendant without counsel appeared before the magistrate who issued the warrant and waived his right to jury trial, pleaded guilty and waived the right to a hearing in mitigation.
