DONALDSON, Justice.

This appeal is brought by the State of Idaho pursuant to subdivision 5, I.C. § 19-28041 and I.C. § 19-2808.2

In September, 1967, the defendants, D. Spencer Grow, Alexander H. Walker, Jr., Horace E. Hayes and Dwaine A. Knigge were charged by indictment with the crime of Falsification of Corporate Books and Records pursuant to I.C. § 18-19053
