Appeal from a judgment and from an order of the district court denying plaintiff's motion for a new trial.

Plaintiff brought an action against defendant, Clarion Taylor, to recover damages for personal injuries sustained as a result of an accident which occurred on June 16, 1965, when a 1960 Studebaker Lark automobile driven by Taylor collided with the rear end of an automobile driven by plaintiff.
