SHERAN, Justice.

Appeal from a judgment of conviction for the crime of murder in the second degree.

On October 6, 1964, at about 4 p. m., defendant, Vernon Hanson, shot and killed his wife, Rosella, at Browns Valley, Traverse County, Minnesota. The weapon used was a .22-caliber rifle which was found to contain 13 rounds of .22 "longs" after the fatal shot had been fired.
