Henry R. Keller, appellant, is a bachelor, 45 years of age, who made his home with his mother, Mrs. Mary E. Keller, until her death in July of 1966. Between July, 1941 and the date of his mother's death, he alleged that he advanced to her, or on her behalf, funds amounting to $75,000 on the expectation and understanding that he would be reimbursed after death from her estate.
