SHAW, District Judge.

This action arises out of an alleged patent infringement. The Court has jurisdiction by virtue of 35 U.S.C. 271, 281 and 28 U.S.C. 1338(a), 1400(b).

Plaintiff, Emory W. Wortington, is the inventor and owner of the patent involved in this litigation. The patent is United States Patent No. 2,869,460 (460 patent). The application for the patent was filed on February 27, 1957, and the patent was issued on January 20, 1959...
