BUSSEY, Judge.

Charles Leroy Jewell, hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Tulsa County, Oklahoma, for the crime of Shooting with Intent to Kill, After Former Conviction of a Felony. The punishment was left to the court and judgment and sentence was pronounced by the court fixing the defendant's punishment at imprisonment in the state penitentiary for a term of fifty (50) years...
