OPINION

TAYLOR, J.

Simultaneously with the direct appeal (People v. Rinegold, No. 8525, ante, p. 711 [92 Cal.Rptr. 12]) from the merits of a judgment of conviction entered on a jury verdict finding him guilty of assault with a deadly weapon (Pen. Code, § 245), this court has been directed to consider a petition for writ of habeas corpus subsequently filed.
