This is an action instituted under the provisions of the so-called Mechanic's Lien Statute to recover for labor and materials furnished by the plaintiff to the residence of the defendant in the Town of Winhall, Vermont. Trial by jury was held before the Windham County Court in April, 1969, with verdict and resultant judgment for the plaintiff. Only two issues are presented by this appeal.
