On August 28, 1970, plaintiffs filed an affidavit that immediate and irreparable damage will result to them before the above matter can be heard. Consequently, we issued a preliminary injunction, enjoining defendant from operating its swimming pool after the hours of sunset and during the nighttime, pending a hearing before us.
