On appeal from a conviction by jury verdict of the offense of breaking, entering and larceny. At the close of the State's case the defendant elected to rest without presenting evidence. Motions for directed verdict of acquittal and for a new trial were seasonably presented and denied. Additionally a motion to suppress evidence was heard and denied by the presiding Justice.
