Gladys Roberts Waggener instituted this suit against William Waggener for divorce, custody of children, support for children, and division of the property of the marriage. The case was tried to the court and a final decree was rendered awarding divorce to the wife, granting to her custody of the two adopted children of the marriage, providing for child support, and dividing the community property.
