On motion of defendant a special venire of 150 persons had been summoned from Person County and was present in court when defendant was arraigned. Upon arraignment the solicitor read the bill of indictment and addressed the prisoner as follows: "How say you, Amos Baldwin, Jr., are you guilty of the felony of murder wherein you stand indicted or not guilty?"
