PEOPLE v. KING

No. 22 October Term 1970, Docket No. 52,792.

384 Mich. 310 (1970)

181 N.W.2d 916

PEOPLE v. KING

Supreme Court of Michigan.

Decided December 30, 1970.

Attorney(s) appearing for the Case

Frank J. Kelley, Attorney General, Robert A. Derengoski, Solicitor General, William L. Cahalan, Prosecuting Attorney, Dominick R. Carnovale, Chief, Appellate Department, and Leonard Meyers, Assistant Prosecuting Attorney, for the people.

Arthur J. Tarnow (Defenders' Office — Legal Aid and Defender Association of Detroit), for defendant.

T.G. KAVANAGH, J.

Defendant was convicted by a jury of armed robbery of a Detroit bar. On appeal from the Court of Appeals' affirmance of his conviction, he claims first, that his pretrial identification by the bar owner and barmaid were inadmissible and, second, that the trial court's comments on the evidence were prejudicial and deprived him of a fair trial.

Regarding the first claim — the tainted identification — we find no error.
