This is an action by a distributor against a manufacturer for damages for breach of a franchise agreement, based upon allegations that the defendant "refused and neglected to deliver and perform said contract." The defendant denies that it breached the contract and by cross-complaint has asked the court to hold that plaintiff terminated the contract, based upon allegations that he refused to accept further deliveries and abandoned all efforts to sell...
