CAFFREY, District Judge.

Defendant was indicted in a one-count indictment charging him with violation of 18 U.S.C. § 922(a) (6). The indictment charges that on or about March 28, 1969, in connection with the acquisition of a firearm, defendant knowingly made a false and fictitious written statement intended to deceive the dealer.
