After expressly waiving in writing his right to a trial by jury, defendant was found guilty by the court of the unlawful possession of heroin and was sentenced to imprisonment for a term of five years.

Defendant's only contention on this appeal is that the trial court erred in failing to sustain his pretrial motion to suppress evidence. In his brief to this court defendant states that his motion for new trial was "limited to the question...
