While defendant was serving concurrent sentences of 1-4 years and 2-3 years at the State Prison, he was involved in an incident which resulted in a hearing before a Disciplinary Court. He was found guilty of flagrant misconduct, with a recommendation to the Board of Managers that defendant forfeit 365 days of earned commutation time.
