Plaintiff appealed from a judgment entered upon a jury verdict for the defendant. The Court of Appeals, by less than a unanimous decision, reversed the trial court (2 Wn.App. 548, 469 P.2d 950 (1970)). Defendant then prosecuted this appeal under Rule II-2, Supreme Court Rules on Appeal.
