Defendant was arrested on October 17, 1968, in Eaton County. A criminal warrant was issued on October 23, 1968, charging the defendant with breaking and entering with the intent to commit larceny, MCLA § 750.110 (Stat Ann 1970 Cum Supp § 28.305).
