OPINION

OMAN, Judge.

Defendant has appealed from his conviction of aggravated battery contrary to the provisions of § 40A-3-5, N.M.S.A. 1953 (Repl. 6). We affirm.

Briefly, the facts are that defendant, twenty years of age at the time of the commission of the offense on March 6, 1969, and an acquaintance of his by the name of Frakes, nineteen years of age, were hitchhiking from Los Angeles, California, to Mason City, Iowa. They were given a ride...
