CASSIBRY, District Judge:

On a previous petition for habeas corpus relief, this Court concluded that Leonard N. Bastida had been denied his constitutional right to effectively confront and cross-examine a witness against him in the state trial which resulted in his conviction for simple burglary. The State was accordingly ordered to vacate Bastida's judgment of conviction, reinstate his plea of not guilty and schedule...
