This is an appeal from a judgment wherein defendant was convicted upon a jury trial of two counts of violation of 18 U.S.C.A. § 659, theft and possession of goods moving in foreign commerce. Defendant, a private security guard, was charged with stealing carnival beads from a box on the New Orleans wharves.
