WHITE v. STATE

No. 43077.

456 S.W.2d 119 (1970)

Billy James WHITE, Appellant, v. The STATE of Texas, Appellee.

Court of Criminal Appeals of Texas.

June 10, 1970.

Attorney(s) appearing for the Case

Kenneth R. Barron, Tyler, for appellant.

Hunter B. Brush, Dist. Atty., and William H. Power, Asst. Dist. Atty., Tyler, and Jim D. Vollers, State's Atty., Austin, for the State.

OPINION

BELCHER, Judge.

The offense is robbery; the punishment, 25 years.

The appellant was originally convicted of robbery enhanced under Article 62, Vernon's Ann.P.C., and his punishment was assessed at life. However, on appeal this Court set aside the life sentence and remanded the case to the trial court for a hearing on the issue of the proper punishment to be assessed by the court.
