Appellant appeals from a conviction of violation of Health and Safety Code section 11501, the unlawful sale of heroin. On March 30, 1970, we filed our original opinion affirming the judgment of conviction. On April 1, 1970, our Supreme Court filed its decisions in Prudhomme v. Superior Court, 2 Cal.3d 320 [85 Cal.Rptr. 129
