This matter comes on on the motion of the defendant Hercules under Rule 56 of the Rules of Civil Procedure, for summary judgment against the plaintiffs, and the Court has decided to grant the motion.

The complaints herein were filed by plaintiffs as the personal representatives of eight employees of Peabody Coal Company who were fatally injured in an explosion on August 7, 1968 in the company's River Queen Underground...
