TAMM, Circuit Judge:

This case arises on cross-appeals from a decision of the district court determining the patentability of a process for producing pure salt brine. The trial court rejected the Patent Office's conclusion that all of the company's seven pending claims were unpatentable; instead, it held that the company was entitled to patents on two of the claims. A third claim was dismissed "without prejudice," all other claims having been withdrawn from suit....
