This is an appeal by Melvin Meller, hereinafter for convenience called defendant, from order denying his petition for habeas corpus relief. Defendant was convicted in the state court on his plea of guilty to an information charging burglary and larceny. He was sentenced to four-years imprisonment on April 22, 1952. His sentence was commuted and thereby service thereof was completed on March 3, 1955. He took no appeal from his state conviction...
