This is an appeal by the State of Montana from an order of the district court of Lewis and Clark County, Honorable Victor H. Fall, district judge presiding.

The decedent, John Precup Giurgiu, died testate on June 22, 1966 in Helena, Montana. His will was duly entered in probate on July 8, 1966. On that date the Union Bank and Trust Company of Helena, Montana was appointed executor of the estate. The will, among other things, provides for distribution...
