The defendant, Neal Henderson, was tried and convicted by a jury of the crime of unlawfully driving away a motor vehicle contrary to CL 1948, § 750.413 (Stat Ann 1954 Rev § 28.645). The defendant was subsequently sentenced to serve three to five years in the State Penitentiary for Southern Michigan; the sentence was set so as to run concurrently with the sentence the defendant is presently serving...
