The subject matter of this suit is an indemnity agreement executed by the parties in January of 1958. Suit was brought on the agreement by Samuel Solomon, counterplaintiff and indemnitee under the agreement, against Jack Lieberman, counterdefendant and indemnitor. Trial was to the court, sitting without a jury.
