This is a suit at law for damages for alleged breach of contract and fraud. Plaintiff contends that in April 1966 the defendants, Shearn Moody, Jr. and Empire Life Insurance Co. of America, entered into a binding contract to advance to plaintiff the sum of $364,000 on or before July 1, 1966; that they breached the contract, and that he was heavily damaged by the breach.
