1. The evidence as to the relationship between Tuggle, the driver of the tractor, and Brown, the owner, was that Tuggle was allowed to live in a house on Brown's farm, rent free, and that when Brown was in need of his services as a laborer he employed him on a day-to-day basis, paying him by the day when he worked.
