OPINION

KINGSLEY, J.

This appeal is taken by the People (under Pen. Code, § 1238, subd. 7) from an order dismissing a burglary prosecution against defendant following the granting of defendant's motion (under Pen. Code, § 1538.5) to suppress evidence obtained as the result of an illegal search and seizure. No dispute exists as to the facts.
