The issues in this case are whether a recount was authorized and, if so, whether the court's finding and ruling that it was valid is sustainable. Plaintiff was declared a selectman of the town of Goffstown following a count of the ballots cast for that position at the town meeting on March 11, 1969. Elmer B. Nickerson was credited with 577 votes, Robert L. Chase with 563 votes and Barbara Poehlman with 562 votes...
