ROGOSHESKE, Justice.

Defendants appeal from an order of the district court denying their oral motion made at a pretrial conference to dismiss plaintiff's action on the ground that the relief prayed for by her complaint seeks to impose a penalty or forfeiture upon defendants and is barred by the applicable 2-year statute of limitations.
