By information defendant Ernest Smith was charged with the murder of Louis Michael Turpin, a violation of Penal Code section 187. On November 14, 1968, after arraignment and entry by defendant of a plea of "not guilty," on motion of defendant the cause was set for trial for January 6, 1969.
