The basic question underlying these motions to dismiss the complaint is whether plaintiff's failure to exhaust her remedies in respect to the suspension of her driver's license, under the Motor Vehicle Safety Responsibility law, bars the action brought against the defendants for damages caused by their refusal to certify to the Director that plaintiff was covered at the time of the accident by liability insurance.
