PAUL A. BENNETT REALTY COMPANY v. HOOTS

No. 7021DC124.

172 S.E.2d 215 (1970)

7 N.C. App. 362

PAUL A. BENNETT REALTY COMPANY v. Carl HOOTS, Trading As Hoots Realty Company.

Court of Appeals of North Carolina.

February 25, 1970.

Attorney(s) appearing for the Case

Roberts, Frye & Booth, by Leslie G. Frye, Winston-Salem, for plaintiff appellant.

Frank J. Yeager, Winston-Salem, for defendant appellee.

HEDRICK, Judge.

The sole question before this Court is whether the trial court committed error in granting the defendant's motion for judgment as of nonsuit. An appeal from a judgment as of nonsuit presents to the court the question of whether the evidence, considered in the light most favorable to the plaintiff, is sufficient to be submitted to the jury. Cutts v. Casey, 271 N.C. 165, 155 S.E.2d 519
