UDALL, Justice:

Defendant Raymond W. Kidwell was convicted on two counts: (1) lewd and lascivious acts, and (2) rape. He was sentenced on May 27, 1969, to a term of from four to five years on the first count and from ten to fifteen years on the second; the sentences were ordered to run consecutively.
