The appellant, Jack Cassidy, a negro, was indicted by the Grand Jury of the Second Judicial District of Jasper County, Mississippi, for the alleged murder of Orvin Pugh, a caucasian. The trial resulted in a conviction of manslaughter, and defendant was sentenced to serve a term of twelve (12) years in the state penitentiary.
