PETERSON, Justice.

On the night of February 15, 1968, Leona Hyleck, the 53-year-old wife of defendant, Jo A. Hyleck, a Duluth businessman, was killed. A grand jury indicted defendant for the crime of first-degree murder, and, after a month-long trial, a jury returned a verdict of guilty of second-degree murder. Minn.St. 609.19.
