This appeal arises from the judgment rendered on a retrial of a mandamus action brought by the plaintiff seeking an order that he be reinstated to his former position in the state service, that he be restored to the roster of state employees with full benefits and that the state comptroller be directed to issue an order to the state treasurer for full pay retroactive to July 28, 1958, when his state service was terminated.
