Appellant was charged with violation of the 1935 Narcotics Act, as amended, as found in Burns Ind. Stat., 1969 Supplement, § 10-3519 et seq. He was charged in Count 1 of the affidavit with the unlawful sale of marijuana and in Count 2 with the unlawful possession of marijuana.
