On January 17, 1968, the defendant was found guilty by a jury in Kent County circuit court of breaking and entering in violation of MCLA § 750.110 (Stat Ann 1970 Cum Supp § 28.305). He was sentenced to 1-1/2 to 10 years in the state prison on February 7, 1968, and given credit for one day served prior to conviction.
