The defendant in this case was arrested at the same time and place and for the same offense as the defendants in People v. Uptgraft (1970) Crim. A. No. 8603, ante, p. Supp.1 [87 Cal.Rptr. 459]. The record is different in many respects but we shall restate the facts only where the differences present different legal problems...
