This is an appeal from a conviction in the Marion Criminal Court, Division Two, of the crime of robbery as defined in Acts 1941, ch. 148, § 6, Burns Ind. Stat. Ann. § 10-4101. Appellant waived trial by jury and this cause was submitted to trial by court. The appellant was adjudged guilty as charged in the affidavit.
