This is an appeal from a decree and judgment in favor of the State of Alabama in an equity suit which sought to recover for five quarterly payments alleged to have been due from appellant Malone pursuant to an alleged contract between appellant and the State Board of Education of Alabama, and sought to recover the penalty on appellant Malone's surety bond from the appellant Auto-Owners Insurance Company of Lansing, Michigan.
