BYRNS, J.

On August 8, 1968 the defendant Elmer Iron, Jr., was convicted by a jury in the Circuit Court for the County of Calhoun of the crime of murder in violation of MCLA § 750.316 (Stat Ann 1964 Rev § 28.548) and was sentenced to life imprisonment. Defendant then filed a motion for a new trial which was denied on September 23, 1968. Defendant now appeals as of right to this Court.
