HOWARD, Chief Judge.

This is an appeal by defendant, David Ross Castro, from a conviction of possession of marijuana, for sale in violation of A.R.S. § 36-1002.06. The jury returned a verdict of guilty to the charge of September 10, 1969, in the Superior Court of Maricopa County, Honorable Willliam H. Gooding presiding. Defendant received a three year suspended sentence and was placed on probation for three years.
